Parental responsibility and its exercise The aim of my final thesis is to analyze parental responsibility and its exercise in the Czech rule of law by the Czech's principle. These thesis contain chapters about historical trends of family law, children rights and development of mutual law and duties of parents and children from the past to present. Some space is also devoted for government interference into parental responsibility. The reason why I chose the theme of parental responsibility for my final thesis is its current status which can be involved for everyone. Final thesis is divided into seven chapters. First chapter contains two parts. The first part is describing family law and explaining its position in a general law and its subject and principle. Second part is about family concept, protection, historical evolution and current situation. The second chapter is connected with legal children's status. It contains five parts. The first part is focused on children's rights, second part is describing a historical origin of the right. The third part is devoted to detail description of children's rights which are included in the Convention of Children's rights. Rights and obligations of parents and children with emphasis on selected issues of development of relationship between parents and children

The family is a term, which is known in each period of history of mankind. It played, playes and will play an important role in life of every individual. It helps to create an identity of individual, a scale of values and principles, which are so necessary for happy life. The topic of my thesis is Rights and Obligations of Parents and Children with Emphasis on Selected Issues of Development of Relationship between Parents and Children. I have chosen this topic because I think that this part of family law is very interesting, especially the questions regarding to the determination of parenthood in the time of the medical breakthroughs. The purpose of my thesis is to analyse Czech legislation with regard to international law. The thesis is composed of six chapters, each of them dealing with different aspects of the relationships between parents and children and the determination of parenthood. Chapter one is introductory. Legislation of Family and Relationships between Parents and Children (with Insights into Past and Future)

The presented thesis provides a comprehensive view of the current legislation on family and parents-children relationships, including insights into past and future. Being a still hot topic is the reason why I chose it for my thesis. Two introductory chapters discuss historical context of family and development of legal relationships between parents and children to date. The family has evolved over time, developed and changed and so has the status of its individual members, which was all reflected in legislation (paternal power, parental power, parental rights and duties, parental responsibilities). The current concept of family is described in Chapter 3, followed by Chapter 4 which gives general characteristics of family law and legal relations within the family, including the definitions of basic concepts used in the rest of the work. Key Chapter 5 discusses the concept of parental responsibilities brought into our law by the so-called "big amendment" to the Family Code (Act No. 91/1998 Coll.). In exercising these rights and duties, parents are obliged to protect the best interests of the minor child, to control his or her actions and to exercise supervision over him or her. Parental responsibility Resumé - Zusammenfassung In der Arbeit habe ich mich mit Felsenklippen beschafft, die aus der spezifischen Verhältnisse zwischen Eltern und Kinder stammen, die Spezifität dieses Verhältnis ist durch die tatsächliche Ungleichheit den Subjekten gegeben, mit der Notwendigkeit die Schutz der schwächeren Seite - des Kindes zu sichern, ihren persönlichen Rechten sowie materialen Versicherung. Weiter die begrenzte Fähigkeit zu rechtlichem Tun des Kindes löst aus nicht nur den Brauch für es handeln, aber auch die Notwendigkeit es lenken, erziehen und die Aufsicht von ihm ausüben, denn das Kind hat begrenzte delinquente Fähigkeit, und die eventuelle Verantwortlichkeit für die Schaden, die einerseits dem Kind anderseits den dritte Personen verschuldet sind, tragen in der Regel die Eltern. Zu dem Vollzug diesen spezifischen Rechten und Pflichten den Eltern ist nötig ihnen die Kompetenz zu überlassen, die wir in anderen rechtlichen Verhältnisse auch nicht finden. Einer der Zielen meiner Arbeit war zu forschen, wie diese tatsächliche Ungleichheit zwischen den Subjekten die rechtliche Aufbereitung kompensiert, denn der Schutz der schwächeren Seite ist eine der Grundsatz, an denen das Privatrecht und vor allem Bürgerrecht basiert. Cochem practice

This thesis deals with Cochem practise as a new way of solving the situation of child renduring the break up or divorce of parents. The introductory chapters describe the history of Cochem practise, the gradual adoption of its principles in Germany and the Czech Republic. It also describes the multidisciplinary cooperation of individual actors of the Cochem model, namely judges, workers of social and legal protection of children, family counselors, mediators, lawyers and experts. In the second part the thesis deals with the proces of realizing Cochem practise at a specific work place of the department of autority child protection. The thesis deals with the progress of the individual members of the multidisciplinary team and with how parents respond to the new approach.

Parental responsibility and restricting interventions by state

The thesis deals with parental responsibility and potential state intervention as an important part of family law, or in some cases civil law, which is regulated by Act No. 94/1963 Coll., on the Family (the "Family Act"), and Act No. 89/2012 Coll., the Civil Code, effective from 1 January 2014. The thesis centres on an analysis of the legal regulation of parental responsibility and potential interventions, especially in the context of current case law and professional literature. In the thesis I consider the imposition of corrective measures; suspension, restriction and termination of parental rights, and necessary substitutes for family care such as foster care, protective youth and young offenders rehabilitation, adjudicated treatment in a special in-patient institution, and the cases of adoption without parental consent. The thesis also includes a comparison of the current legislation of the parental responsibility and potential interventions according to the Family Act and incoming legislati on according to the Civil Code.

1 RESUME This Honours Project has a character of comaparing theory. It is devided into six chapters. In the first chapter is specified The Office of the Public Guardian. The second chapter is focused on historical development and is devided into four sub- chapters. The special guardianship regulations from the times of Roman law all the way to the latest history are discussed in these four sub-chapters. The third chapter is comparing The special guardianship regulations of The family law number 94/1963 of Civil Code which was subsituted by new law 89/2012 of Civil Code valid from 1st January 2014. It is comparing the special The fourth chapter called The guardian ad litem and other forms of guardianship is describing the these forms by the valid Special guardianship regulations and comparing with The guardian ad litem. The fifth chapter is focusing on the guardian's allowance for the personal use of the minor. The last sixth chapter gives us the characteristics of current social and legal children protection system in Czech Republic. They include a closer specifiation of Divisions of the public sector effecting.
